On September 9th 2016, the IBU received the decision from the Anti – Doping Hearing Panel, for the cases of Eduard Latypov, RUS, Artem Tyshchenko, UKR and Eva Tofavli, ROU. Following the study, WADA issued Notice on June, 30 providing the guidance regarding managing meldonium cases. The Anti-Doping Hearing Panel stated that for all three cases, the Notice's first table applies, "In the absence of other evidence of use on or after 1 January 2016, a finding of no fault may be made." Following analysis of WADA notice and considering Article 10.8 IBU Anti-Doping Rules ("all... competitive results obtained from the date a positive sample was collected...., through the commencement of any provisional suspension...., shall, unless fairness requires otherwise, be disqualified...") the Anti-Doping Hearing Panel came to following decisions: 1) All three above mentioned athletes are found guilty of anti-doping rule violation in the form of the presence of a prohibited substance, according to Article 2.1 IBU ADR 2) Since they bear no fault the otherwise applicable period of ineligibility is eliminated, according to Article 10.4 IBU ADR. 3) Disqualification of all competitive results with all resulting consequences for medals, points and prizes for the respective time frame For Mr. Eduard Latypov - February, 14 - March, 8 2016 For Mr. Artem Tyshchenko - January, 23 - February 16, 2016 For Ms. Eva Tofavli - March, 8 – March, 29 2016 The respective athletes, their NADOS, the IBU and WADA have now the possibility to appeal the decision to CAS within 21 days.
